Freight and Shipping
· All orders will be shipped F.O.B. from Lexington, MI.
· We will provide freight quotes upon request. These are only estimates
not guaranteed prices. No freight quote is guaranteed by Donovan Enterprises.
· Prepay and add: Upon the distributors request Donovan Enterprises may
prepay freight and add the freight charges to the total invoice.
· Prepaid freight: Donovan Enterprises, Inc. will pay the freight on all
eligible shade orders that meet the dollar requirement of $250.

Other Donovan Policies Prices and Discounts
· Price lists: All published price sheets reflect List or Fleet pricing,
unless otherwise designed as "Distributor Price Sheets".
· All prices are subject to change without notice.
· Discounts: any and all discounts must be approved by Donovan Enterprises.
We reserve the right to refuse discounts at any time for any reason. An
offer for special pricing may not be combined with any other special being
offered at that time. You may take advantage of the "best" offer, but
cannot combine offers at any time for any reason. No exceptions.

Terms and Conditions
· Donovan requires a tarp diagram for every special tarp to assure we
are making the tarp to your specification. Any tarp made wrong that was
not accompanied by a drawing is not the responsibility of Donovan Enterprises.
· Distributor Entitlements: Each distributor will be issued a Tarp Dealer
Catalog. Acceptance as a Tarp Distributor does not guarantee acceptance
as a Heavy Duty Truck Covering Systems Distributor, Diamond Slide Bedliner
Distributor, or Waste Covering System Distributor. Available upon request
are color product brochures, tarp samples, and other promotional items.
· To open an account with Donovan Enterprises, Inc., a credit application
must be completed and submitted to Donovan Enterprises. Upon receipt of
a $500 minimum order, the credit application will be processed through
Dun & Bradstreet's Credit Information Service to determine a customer's
eligibility to receive credit. A credit account will be opened and a credit
limit will be established based on the results of the credit rating by
Dunn & Bradstreet. Donovan is not responsible for fixing a customers credit
report.
· Payment terms: The net amount of invoices will be due and payable within
30 days of date of invoice. A 2% discount will be given for payment received
within ten days of the date of the invoice.
· Past due accounts: past due accounts will be charged 1 ½% interest per
month on unpaid balances. No orders will be shipped to past due accounts.

To obtain Warranty Service, Please follow these instructions:
· The first step to receiving warranty is to remove the tarp or shade
panel in question and return it to our dealer from whom you bought the
tarp. If that dealer is not close by, no longer in business, or is not
an option, any Donovan Dealer can handle this warranty procedure. We would
however prefer you use the dealer you bought the tarp from. For help in
determining the closest dealer call us 800-327-8287.
· The dealer will contact us to get a RA# (Return Authorization Number).
This number will need to be clearly marked on the outside of the package
when it is sent back to Donovan's Florida address. *Our warranty on tarps
and shade panels is 90 days from the date that you purchased the tarp.
It is very important we issue the #RA before the 90 day mark.
· The freight required to return a tarp must be pre-paid by the distributor/end
user. Send the tarp to 5100 Lakeshore Drive, Lexington, MI 48450
· If the end user requires a replacement immediately, they must pay for
the replacement tarp. A refund can be issued to that end-user once we
deem the tarp to be under warranty and issue a credit to the distributor.
*Warranty is not guaranteed so please do not assume warranty and replace
tarp at no charge. If for some reason the tarp does not meet warranty,
we will not cover a tarp that was replaced in expectation of warranty.
· When we receive the tarp at our Michigan facility, we will inspect the
tarp and make a determination as to whether it meets warranty requirements.
If it does, we will issue a credit or send out a replacement tarp. If
the tarp does not meet warranty requirements we will fill out a form explaining
why. Either way, we will call the distributor to inform them of whether
the tarp meets our warranty requirements and how we plan to take care
of the situation.
· You should expect an answer within 7 days of us receiving the tarp in
our Michigan facility.
· If a tarp is found to be under warranty, we reserve the right to repair
the tarp. If we are unable or choose not to repair the tarp we will then
replace the tarp.

THE BREACH OF THIS LIMITED WARRANTY. TO THE EXTENT PREMITTED BY APPLICABLE
LAW. DONOVAN MAKES NO OTHER WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED,
WITH RESPECT TO THE PRODUCT.
Some states do not allow the exclusion or limitation of incidental or
consequential damages, or allow limitations on how long an implied warranty
lasts, so the above limitations or exclusions may not apply to you. This
limited warranty specific legal rights, and you may have other rights
which vary from state to state.

Dealer Warranty
Donovan neither assumes nor authorizes any other person, natural or corporate,
to assume for Donovan any other obligations or liabilities in connection
with or with respect to any part(s) of a Product. The seller or dealer
of part(s) of a Product has no authority, whatsoever, to make any representations
or promises on behalf of Donovan or to modify the terms of limitations
of Donovan's warranty in any way.

What is covered:
Donovan's Tarp Warranty
covers defects in materials and workmanship for a period of 90 days. We
will replace a tarp if a hem or weld has come apart and causes the tarp
not to work properly within this time frame. Donovan's warranty does not
cover tearing, ripping, or melting of material. The application in which
the tarp is used will determine the amount of time a tarp will last. *A
tag is sewn into each tarp and states the size of the tarp, when and where
it was made, and who made the tarp. Removing this tag will void any tarp
warranty no exceptions.
What is not covered:
Donovan Enterprises Inc.
will not be liable or responsible to supply or pay labor to replace any
part found to defective, nor shall it be liable for any kind of damages
of any kind or nature to person, product, property, or other consequential
damages.
· Damage caused by exposure to high heat (melted or burned material).
· Damage caused by improper installation, operation, or abuse.
· Damaged
caused by chemical or environmental exposure.
· Damage due to the lack
of the proper circuit breaker.
· Consequential losses or damage to equipment
or materials
· Consequential expenses such as labor, delays, vehicle downtime,
loss of revenue, etc.
